Terms of Service

1. Acceptance of Terms

By accessing or using the Ads Uploader service, website, or any applications made available by Ads Uploader (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, you may not access or use the Service.

2. Description of Service

Ads Uploader provides a platform that allows users to efficiently upload and manage media content for use in Meta (Facebook) advertising campaigns ("Service"). The Service includes features to bulk upload images and videos, automatically match thumbnails to videos, and export XSLX files for use with Meta Ads Manager.

3. Facebook Integration

The Service integrates with Facebook's services to enable content uploads and data management for advertising purposes. By using our Service, you acknowledge and agree that:

  • You must comply with Facebook's Terms of Service, Advertising Policies, and Community Standards
  • You authorize Ads Uploader to access your Facebook account data as necessary to provide the Service
  • Ads Uploader is not affiliated with, endorsed by, or sponsored by Facebook, Meta, or any of their affiliates
  • Facebook's policies and functionality may change, which could affect how our Service operates

4. User Accounts

To use the Service, you must create an account and authenticate through Facebook. You are responsible for:

  • Maintaining the confidentiality of your login information
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring that all account information you provide is accurate and up-to-date

Each individual using the Service must have their own account. Account sharing is prohibited as it violates our security protocols and Facebook's authentication requirements.

5. Free Trial and Billing

We offer a 7-day free trial of our Service. After the trial period, continued use requires payment of the subscription fee. By providing payment information, you agree to:

  • Pay all charges at the prices in effect for your subscription when the charges are incurred
  • Keep your payment information accurate and up-to-date
  • Bear any additional charges that your bank or payment provider might impose

All fees are exclusive of taxes unless stated otherwise. If the Service is subject to any taxes, you are responsible for paying them.

6. Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation:

  • You will continue to have access to the Service until the end of your current billing period
  • Your subscription will not be renewed after the current billing period ends
  • We do not provide refunds for unused subscription time

7. User Content

You retain all rights to the media content you upload through our Service. By using the Service, you grant us a limited license to:

  • Store, process, and transmit your content as necessary to provide the Service
  • Transfer your content to Facebook according to your instructions

You are solely responsible for all content you upload through the Service. You represent and warrant that:

  • You own or have the necessary rights to the content you upload
  • Your content does not violate any third party's intellectual property rights
  • Your content complies with Facebook's advertising policies and all applicable laws

8. Prohibited Uses

You agree not to use the Service to:

  • Upload illegal, harmful, threatening, abusive, or discriminatory content
  • Upload content that violates Facebook's advertising policies
  • Attempt to gain unauthorized access to the Service or systems
  • Interfere with other users' access to the Service
  • Reverse engineer or attempt to extract the source code of the Service
  • Use the Service to generate automated, fraudulent, or misleading advertisements

9. Limitation of Liability

To the maximum extent permitted by law, Ads Uploader shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Any issues arising from changes to Facebook's policies or APIs
  • The performance of advertisements uploaded using our Service
  • Temporary unavailability of the Service

Our total liability for any claims under these terms shall not exceed the amount you've paid us in the past six months.

10. Changes to the Service or Terms

We reserve the right to modify or discontinue the Service at any time. We may also update these Terms of Service from time to time. If we make material changes, we will provide notice through the Service or by other means. Your continued use of the Service after such notice constitutes your acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state of Delaware, without regard to its conflict of law provisions.
